Terms of Service

Welcome to BearyTime. These Terms of Service (“Terms”) govern your use of our website and services. By creating an account or placing an order, you agree to these Terms. If you do not agree, do not use our services.

1. Who We Are

BearyTime provides personalized AI-illustrated children’s storybooks paired with a plush companion bear. Our services are intended for parents and guardians purchasing for children in their care.

2. Eligibility

You must be at least 18 years old and a parent or legal guardian to create an account. By creating an account, you confirm that you have the authority to consent to the collection and use of any child’s information you provide.

3. Child Likeness & AI Use Authorization

When you create a child profile and use our story generation service, you grant BearyTime and its AI service providers (including Fal.ai) a limited, non-exclusive license to use your child’s name, physical description, and photo (if provided) solely to generate personalized illustrated story content for your account.

This authorization is subject to the following conditions:

  • Your child’s likeness will be used only to create personalized adventures within your BearyTime account. No other commercial use will be made without separate written consent.
  • Your child’s photo, description, and all personal information will never be used to train AI models by BearyTime or any third-party provider.
  • You may revoke this authorization at any time by deleting the child’s profile from your account or by contacting support@bearytime.com. Upon revocation, all data associated with that child’s profile will be deleted promptly.

4. Orders, Payments & Refunds

  • All prices are in USD. Payment is processed securely through Stripe.
  • Physical orders (plush bears) are shipped to the address you provide. You are responsible for ensuring the shipping address is accurate.
  • Digital story content is delivered to your account upon successful payment.
  • Due to the personalized nature of our content, digital adventures are non-refundable once generated. Physical products may be returned within 30 days if unused and in original condition — contact us to initiate a return.

5. Account Responsibilities

  • You are responsible for maintaining the security of your account credentials.
  • You agree to provide accurate and current information.
  • You are responsible for all activity that occurs under your account. Notify us immediately at support@bearytime.com if you suspect unauthorized access.

6. Acceptable Use

You agree not to:

  • Use our services for any unlawful purpose
  • Submit content that is offensive, abusive, or inappropriate for children
  • Attempt to gain unauthorized access to any part of our systems
  • Use our services to generate content featuring individuals without their (or their guardian’s) consent
  • Resell or redistribute personalized story content without permission

We reserve the right to suspend or terminate accounts that violate these provisions.

7. Intellectual Property

The BearyTime name, logo, website design, and platform software are our proprietary property. Story content generated for your account is licensed to you for personal, non-commercial use only. You may print and share adventures with your family but may not resell or publicly distribute them.

8. Disclaimer of Warranties

Our services are provided “as is” without warranties of any kind, express or implied. We do not guarantee that AI-generated content will meet every specific expectation, that the service will be uninterrupted, or that illustrations will perfectly match your child’s appearance.

9. Limitation of Liability

To the fullest extent permitted by law, BearyTime will not be liable for any indirect, incidental, or consequential damages arising from your use of our services. Our total liability to you for any claim will not exceed the amount you paid us in the 12 months preceding the claim.

10. Changes to These Terms

We may update these Terms from time to time. We will post the updated version with a new effective date. Continued use of our services after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the United States. Any disputes will be resolved through good-faith negotiation first. If a dispute cannot be resolved informally, it shall be submitted to binding arbitration under the American Arbitration Association rules.
